Updating CBD Regulations: Bipartisan Legislation Aims to Ensure Consumer Safety and Access to Potential Health Benefits

In recent years, CBD (cannabidiol) has gained significant popularity as people seek natural alternatives for promoting overall well-being.[0] CBD, derived from the cannabis plant, has been recognized for its potential health benefits and has paved the way for a wide array of CBD products on the market. However, the regulation of CBD has been a topic of debate and concern.

To address this issue, bipartisan federal lawmakers introduced legislation in July 2023 aimed at updating federal hemp rules to ensure that hemp-derived CBD products are regulated by the U.S. Food and Drug Administration (FDA) like other legal products found in dietary supplements, foods, and beverages. This legislation would give CBD products the opportunity to be lawfully used in these products and would prioritize consumer safety by requiring manufacturers to comply with all existing federal regulations for CBD-containing products.[1]

The need for updated regulations is evident as CBD shops, such as the Old Manchester Hemp Co. in Virginia, have closed their doors due to the restrictive regulations in their state. The owner, Anthony Mijares, felt that the regulatory environment in Washington, D.C. was more favorable and made the decision to relocate his business there.[2]

One of the concerns surrounding CBD usage is the risk associated with vaping CBD, especially among young people. Dr. Diane Tanaka, the medical director of the Teenage and Young Adult Health Center at Children's Hospital Los Angeles, highlighted the under-recognition of risks among young people when it comes to vaping CBD or cannabis. She emphasized the need for more education and sharing of potential health risks associated with vaping CBD.[3]

However, CBD also has its benefits. It exhibits powerful anti-inflammatory properties, which can support better recovery and reduce excess inflammation that can stress the immune system.[4] CBD interacts with CB receptors in the body to reduce the intensity of stimuli and has been recognized for its potential in reducing joint inflammation.[4]

CBD is a safe and effective therapeutic option for patients with highly drug-resistant epilepsies, according to a real-world study published in the journal Seizure.[5] The study showed that CBD led to a dramatic reduction in seizure frequency in over 25% of patients.[6]

It's important to note that CBD is not psychoactive like its cousin THC (tetrahydrocannabinol), which is the main active ingredient in marijuana.[7] CBD offers potential health benefits without the “high” associated with cannabis use.

The popularity of CBD has led to the availability of various CBD products on the market, including vape juices, topicals, tinctures, oils, creams, edibles, and more. It is generally simple to use CBD products and include them in one's daily routine. One way to consume CBD oil is by adding it to food or drinks or administering it directly under the tongue with a dropper.[8] Like any other supplement, CBD gummies or capsules can be consumed with water.[8]

In conclusion, the regulation of CBD is a topic of ongoing discussion and debate. The introduction of bipartisan legislation aims to update federal hemp rules and ensure that hemp-derived CBD products are regulated by the FDA like other legal products. While concerns exist regarding the risks of vaping CBD, CBD also offers potential health benefits, particularly for reducing inflammation and treating highly drug-resistant epilepsies.[5] The popularity of CBD has led to a wide array of products on the market, making it easy for individuals to incorporate CBD into their daily routines.
